Your local Toyota dealers proudly supported Flyers Charities by providing a new 2008 Toyota FJ Cruiser for a special end of hockey season raffle.

Official Raffle Rules

Eligibility:  The raffle (“Raffle”) is open only to legal residents of the United States, 21 years of age and older and possessing a valid U.S. driver’s license as of the date of entry.  The following persons and their dependents are not eligible to enter or win: employees of Comcast Spectacor Foundation (the “Sponsor”) and Pennsylvania New Jersey Toyota Dealers Association d/b/a Tri-State Toyota Dealers Association (“Toyota”) and the parents, affiliates, subsidiaries, advertising and promotion agencies, franchises and printers and distributors, and the immediate families (spouse, parents, siblings and children) and members of household of each of the above. 

To Enter:  To qualify for the Raffle, all entries must be received by the end of the 2nd period of the Philadelphia Flyers game on April 6, 2008.  One (1) winner will be drawn at random from all eligible entries on or about April 6, 2008.  Sponsor reserves the right to delay the drawing.  The purchase price of one Raffle ticket is $50.00.  Payments may be made by cash, check or credit card through the Comcast Spectacor Foundation office (215-609-1646) or at the Comcast Spectacor kiosk located on the concourse level of the Wachovia Center during Philadelphia Flyers home games through April 6, 2008.  Checks should be made payable to Comcast Spectacor Foundation.  If entrants’ check or credit card is dishonored by the bank or credit card company, the entry ticket will be invalid unless full payment is received by the Comcast Spectacor Foundation office by the 2nd period of the Philadelphia Flyers game on April 6, 2008.  Purchasers of Raffle tickets must legibly write their full names, addresses and telephone numbers on the Raffle ticket.  If more than one name is listed on the ticket, the first name listed shall be considered the “entrant.” The winner will be notified via e-mail and/or by telephone on or about April 7, 2008.  The winner must respond to e-mail or voicemail notification within five (5) business days, or he/she will forfeit the prize.  If the winner does not respond within the time limit, Sponsor reserves the right to draw an alternate winner from all remaining eligible entries.  The winner may be required to execute and return, prior and as a condition to receiving the prize, an affidavit of eligibility and liability release and, except where prohibited by law, a publicity release.

Prize:  One (1) Prize:  The winner of the Raffle will receive one (1) 2008 FJ Cruiser (Approximate Retail Value: $30,000).  All expenses not stated herein (including but not limited to, taxes, title, license, registration, insurance, fuel, additional vehicle equipment and other costs and expenses related to the winner’s acceptance and/or use of the prize) are the responsibility of the winner.  Proof of insurance must be provided prior to delivery.  The winner cannot assign or transfer the prize to another person and may not redeem the prize for cash or otherwise.  No substitutions or exchanges will be provided, except that Sponsor may, in its sole discretion, substitute a prize for one with an equal or greater retail value.  The winner accepts the prize “AS IS” and Sponsor and Toyota accept no responsibility for repairing any real or supposed damage to the prize.  Toyota shall designate the Toyota dealership at which delivery and prize acceptance will occur.  Sponsor and Toyota shall, will and can have no obligation for delivery of the prize to any person other than the entrant.  Toyota will report the full cost of the prize to the IRS and the winner must fill out a W9 form and/or any other applicable tax documents as a prerequisite of winning the prize.  It is the sole responsibility of the entrant to allocate the prize in any multiple party entry. 

Odds:  The odds of winning the FJ Cruiser depends on the number of eligible Raffle tickets received.

Publicity:  Except where prohibited, participation in the Raffle constitutes the winner’s consent to Sponsor’s use of the winner’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration. 

Release:  By entering, each entrant agrees to follow these rules and hold harmless and indemnify Sponsor and Toyota and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, franchises, printers and distributors. 

Limitations of Liability:  Sponsor and Toyota and their respective agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, and legal advisors (collectively, the “Released Parties”) are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Raffle; (iv) electronic or human error which may occur in the administration of the Raffle or the processing of entries; (v) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Raffle;  or (vi) any printing or typographical errors in any Raffle-related materials; or stolen, lost, late, misdirected, damaged, incomplete or illegible entries.

General Conditions:  Sponsor reserves the right to cancel or modify the Raffle if fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Raffle, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to draw the winner at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Raffle or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Raffle is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
